Smart Communications, Inc. ("SMART", "We", "Us", or the "Company") respects your fundamental right to privacy, and we commit to take great care in safeguarding your personal data. In compliance with the Data Privacy Act, we share with you the principles that govern how your data will be collected, processed, and shared as you use the KiQ App.
The KiQ App makes it easy for you to manage and personalize your mobile services — and we're working on adding even more features soon! We only collect and use the personal information we need to provide you with the best possible telecom experience.
To begin using the KiQ App, please create an account by providing your full name, email address, and a chosen password. As part of the registration process, we will verify your email address by sending a one-time password (OTP) to the address you have provided. You will be required to enter this OTP on the sign-up screen to successfully complete your account creation.
When logging in, you will be asked to enter your registered email address and password.
After successfully creating your KiQ App account, you will be able to purchase a KiQ eSIM and a package of your choice ("Plan It Your Way" or "Choose Your Data Package"). To complete your purchase, you will be directed to a payment gateway operated by Maya Philippines, Inc. ("Maya").
Depending on the payment method you choose, Maya may require you to provide additional information, such as your credit/debit card details or your e-Wallet account information, to complete the transaction.
We do not have access to any financial information you submit through the payment gateway. Any information you provide through the payment gateway is governed by the terms of use and privacy policies of Maya, the issuing bank of your credit or debit card, and/or the provider of your e-Wallet, depending on the payment option you select.
However, we do share information with Maya, such as the payable amount, to allow them to properly process your purchase. Maya then provides confirmation of whether your transactions were successful, enabling us to display your transaction history in the KiQ App.
In compliance with the SIM Registration Act, you must first register your KiQ eSIM before we activate it. To register, tap the "Activate Now" button on your homepage. You will then be able to complete the required SIM registration within the KiQ App.

After your SIM registration is approved, the KiQ eSIM will be activated. You can then download and activate the eSIM on your device. It is your responsibility to ensure the KiQ eSIM is activated on either your own device or another device that you have authorized.
All transactions and purchases made for KiQ eSIMs through your KiQ App account are your responsibility as the KiQ App account owner.
When your KiQ eSIM is successfully registered, activated, and added to your KiQ App account, you may perform the following transactions:
We gather data regarding your interactions with the KiQ App — including app clicks, purchase transactions, session statistics, and comparable usage metrics — pursuant to our legitimate interest in enhancing your user experience. This information enables us to evaluate the App's performance and develop new features that serve all users.
This information is never analyzed or profiled in a way that personally identifies you.
We engage the services of Amdocs Philippines, Inc. ("Amdocs") and Aventis Technologies Pte Ltd ("Aventis") for the development, operations, and maintenance of the App. We also work with ZOLOZ Global ("ZOLOZ") to enable the automated validation of the personal data you submit when you register your eSIM.
We grant access to your personal data to our trusted service providers—Amdocs, Aventis, and ZOLOZ—so they can effectively carry out tasks on our behalf. They are required to follow our instructions and uphold strict confidentiality and security standards, in line with this Privacy Notice and applicable privacy laws and regulations. Access is limited only to authorized personnel who need the information to perform their duties.
The integrity, confidentiality, and security of your personal data is important to us. This is why we strictly enforce this Privacy Notice and have implemented technical, organizational, and physical security measures that are designed to protect your information from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful activities. Your personal data is also protected from other natural and human dangers. We require Amdocs, Aventis, and ZOLOZ to implement the same or equivalent security measures.
We keep your personal information relating to the KiQ App in our records for an additional 120 days after your last base package expired after which your mobile number will automatically be deleted. However, should you intentionally delete your KiQ App user account, we will delete all your data after 90 days including your personal information, purchase history, and other stored information.
The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under the law, you are entitled to request:
Depending on the circumstances, such as when we process your personal data based on your consent, you may also have the right to object to the processing thereof.
To exercise any of these rights, you may get in touch with our Data Privacy Officer through the contact details provided below. In some instances, we may request for supporting documents or proof before we effect any requested changes to your personal data.
If, despite our commitment and efforts to protect your personal data, you believe that your data privacy rights have been violated, we encourage you to come to SMART first so that we can work together to resolve your complaint. You have the right at all times to register a complaint directly with the National Privacy Commission or to make a claim against us with a competent court.

From time to time, we may update this Privacy Notice to comply with changes in applicable laws, to comply with government and regulatory requirements, to adapt to new technologies and protocols, to align with industry best practices, and for business purposes.
You will always be provided notice if these changes are significant and, if we are required by law, we will ensure to obtain your updated consent.
